Cornyn Could Face Senate Resistance If Tapped By Trump To Lead FBI

On the upswing, he was rumored to be shortlisted as the next director of the Federal Bureau of Investigation - then one of his fellow GOP senators said he'd be a bad choice as the government's top cop. So unless the conference gives Cornyn a waiver to serve longer, the senior senator from Texas will go from the number two Republican in the Senate to just another senator, albeit one with seniority.

A Change.org petition to stop Cornyn from speaking criticized his approval of DeVos and Attorney General Jeff Sessions as well as his stance on "sanctuary cities" and voter ID requirements, among other policies.

Also being considered for the job are attorney Alice Fisher, NY Court of Appeals Judge Michael Garcia, Virginia District Judge Henry Hudson, FBI special agent-in-charge Adam Lee, acting FBI director Andrew McCabe, former congressman and FBI special agent Mike Rogers, and former Homeland Security advisor Fran Townsend.

On Tuesday, President Trump fired James Comey from the position, tweeting in part: "Comey lost the confidence of nearly everyone in Washington: Republican and Democrat alike".

Whether Cornyn sought the position or was asked to interview for it is unclear, because late last week he was assuring journalists that his focus was on serving in the Senate.

Senate Democrats likely will stall on whomever Trump nominates while Republican senators such as Susan Collins of ME and Lindsey Graham of SC have voiced concerns over nominating someone to the position who works in a partisan environment. Comey served for three and a half years before being dismissed by Trump.

Other possible nominees are, according to the reports, acting FBI Director Andrew McCabe; Alice Fisher, formerly Justice Department criminal division chief; and Michael Garcia, a NY state appeals judge and former U.S. attorney in New York's Southern District.

Texas would eventually have to hold a special election to fill Cornyn's term which expires in 2021.

One protester said he would press Cornyn to "assign a non-partisan independent commission to investigate potential Russian election interference".

"This demands a serious down-the-middle investigation", the Democrat said of the Trump-Russia question.

"I think the process is going to go quickly. I told him I was interested in having a conversation and, basically, that's what we did", Cornyn said. "That issue was settled many years ago when the Supreme Court ruled in 1974 that the tapes that President (Richard) Nixon had should be turned over to Congress".

"It's now time to pick somebody that comes from within the ranks or is of such reputation that has no political background at all", Graham said.
