Trump admin amends travel ban date to keep legal battle alive

  • Another US appeals court keeps US President Donald Trump's travel ban blocked

The court's processing of the Trump Administration's appeals in the two cases has been slowed down a bit because one of the lower court decisions it is now being asked to review just came out on Monday, when the other case was almost finished with the filing of briefs.

The executive order, which is seeking a 90-day ban on travel to the United States for people from six Muslim-majority nations, has been making its way through the courts since it was first signed by President Donald Trump several months ago.

As for Gorsuch's investiture ceremony, there will probably be no explicit talk of Trump's travel ban but the controversial executive order will surely loom large nonetheless.

"President Trump knows that the country he has been elected to lead is threatened daily by terrorists who believe in a radical ideology, and that there are active plots to infiltrate the USA immigration system - just as occurred prior to 9/11", Sessions said in a statement on Monday.

The Supreme Court has asked the federal government and states challenging the ban to submit arguments.

Trump's appointment of conservative Gorsuch has been his most significant win since taking office in January.

In a statement, he said: "I am heartened by the decision of the 9th Circuit to maintain the temporary halt implementing certain provisions of the March 6th Executive Order".

Trump's visit to the court would be his first since he became president on January 20 and would put him face-to-face with the nine justices as they consider the fate of his travel ban unless the court acts before then.

The government disagreed, arguing that the injunction by Hawaii federal judge Derrick Watson had stopped the clock on the 90-day, six-country and 120-day refugee ban.

In the second case, the Richmond, Virginia-based 4th U.S. Circuit Court of Appeals, on May 25 upheld the Maryland judge's ruling.

One of the nominees, according to The Washington Times, Colorado Supreme Court Justice Allison H Eid, is being earmarked by the President to fill a vacancy on the 10th US Circuit Court of Appeals which opened up when Justice Neil Gorsuch was confirmed for the Supreme Court in April. The second order was meant to overcome the legal issues posed by the original ban, but was blocked by judges before it could go into effect on March 16.
